EXCLUSION OF RIGHT OF WITHDRAWAL

The landlord points out that reservations you make are legally final. A right of withdrawal (the so-called cooling-off period) of 14 days does not apply to the agreements you conclude with the landlord.

Article 1. General terms and conditions and definitions

These general terms and conditions apply to a temporary rental agreement between the landlord and the tenant of a room, apartment or holiday home belonging to Courcenay, 505 Chemin de Courcenay, 69240 Mardore, France.

Tenant: the person who rents the room, apartment or holiday home from the landlord for a certain period of time and has paid the agreed rental price to the landlord.

Landlord: Richard Hendriksen EI, is the person who rents the rental property to the tenant.

Rental agreement: agreement between the tenant and the landlord regarding the rental of an apartment or holiday home.

Owner: the owner of the apartment and holiday home.

Rental price: price per night multiplied by the number of agreed nights. The rental price can be increased with costs (and any deposit).

Deposit: the part of the rental price that the tenant owes the landlord when booking. The deposit currently amounts to 25% of the travel sum and must be paid within 7 days by Ideal or Credit card. All payments are made via Mollie. The booking is only final after receipt of the deposit.

Arrival and departure time: the times agreed between the tenant and the landlord.

Article 2. Establishment of rental agreement

The landlord informs the tenant about the rental property, prices and conditions that are important for the establishment of the rental agreement. The rental agreement is established after the tenant has fully completed and sent the booking on the landlord's website and after the confirmation of this has been sent to him by the landlord (e-mail). In addition, if you wish to bring one or more dogs (max. 3 without further permission), the landlord will always ask for breed details and possibly a photo(s) of the dog(s). This is to verify that the dog(s) comply with French law for admission to France. See also our page "Dog rules in and around Courcenay". The rental agreement can only be concluded after approval of this.

Article 3. Payment conditions

Within 7 days after booking on the landlord's website or by email, the deposit must be made by the tenant via the Mollie link on the (proforma) invoice that the landlord sends to the tenant by email.

If the deposit has not been provided within the set period, the rental agreement is deemed not to have been concluded. The full rental price must be transferred to the landlord's account no later than 6 weeks before the start of the rental of the room or house. If this is not complied with, the right to rent the apartment or holiday home will lapse, taking into account the provisions of article 9.

If the booking is made less than 6 weeks before the start of the rental, the entire amount due must be paid within 7 days via the Mollie link on the invoice. If the payment is not credited to the landlord's bank account within the set period, the rental agreement is deemed not to have been concluded.

Article 4. Costs

If costs apply in addition to the rental price, this will be stated on the landlord's website. The tenant will pay these in the same way as the rental price.

Article 5. Deposit

The deposit of € 250 must be paid to the owner upon entering the room or apartment/holiday home. The deposit will be refunded to the owner's bank account within one week after the agreed period of stay, minus any costs for damage, defects and/or loss or disproportionate energy consumption. Any deduction is reasonable and at the owner's discretion.

Article 6. Obligations of the landlord

The landlord ensures that the room, apartment/holiday home is made available to the tenant at the agreed arrival time in a well-maintained condition and in accordance with the booking confirmation.

Article 7. Tenant's obligations

Upon arrival at the room or apartment/house, the tenant is obliged to inspect it and the immediate surroundings for any unsafe situations. If the tenant believes that there is an unsafe situation, he will immediately inform the owner. The tenant will give the owner a reasonable amount of time to rectify the situation.

Overnight stays are permitted in the room, apartment/house for the number of persons stated on the booking confirmation.

Overnight stays of visitors are only permitted after prior permission from the landlord and payment of an additional rental price to be agreed upon. It is not permitted to allow persons into the room, apartment or holiday home without the landlord's permission, other than the tenant and any persons designated by him or friends, acquaintances or family. The tenant is responsible for all persons mentioned.

In the event of violation of the aforementioned provisions, the rental agreement will be terminated with immediate effect and access to the apartment will be denied. The tenant remains liable for the full rental price. After termination of the agreement, the owner is entitled to rent the rented property directly to another party.

Furthermore, it is not permitted to open closed spaces. When leaving the room, apartment or holiday home, even for a short period of time, it must be completely closed. In the event of theft or loss as a result of failure to comply with this, the tenant will be held liable for all damage. Smoking is not permitted in the entire property. In the event of fire as a result of negligence, the tenant will be held liable for the damage.

Normal use of water and electricity is free of charge. If it appears that there is disproportionately high consumption, the actual costs will be charged to the tenant.

The tenant is not permitted to charge an electric or hybrid car with any form of connection to the Courcenay electricity network. The Courcenay network is not designed or cannot be designed for this. Any form of damage caused by charging a car via the Courcenay electricity network is entirely the responsibility of the tenant.

Article 8. Arrival and departure from the room, apartment or holiday home

Arrival and departure take place on the arrival and departure dates stated in the booking confirmation. The tenant is allowed to arrive between 3:00 PM and 9:00 PM. Departure must take place before 10:00 AM.

Upon arrival, the tenant checks the room, apartment or holiday home and the immediate surroundings to see if they are safe in his opinion (see article 7.).

Upon arrival, the tenant checks whether the apartment or holiday home and inventory are complete and undamaged. If anything is damaged or missing, the tenant must report this to the owner within 24 hours of arrival. The owner will do his utmost to repair, replace or supplement it.

The tenant must inform the owner in good time (at least 24 hours in advance) of the expected time of departure, who (possibly together with the tenant) will inspect the room, apartment or house.

The room, apartment and/or holiday home will be returned to the tenant after the stay in a clean and "broom clean" condition. For the apartment/house, it also applies that dishes and accessories are put back in the cupboards clean and dry. Moved furniture must be put back in its original place. Damage, defects or missing items must be reported to the owner immediately by the tenant.

Article 9. Termination or amendment of the rental agreement by the tenant

The tenant cannot make any changes to a booking made, other than after consultation with and approval of the landlord.

In the event of full or partial cancellation of the booking of the stay in the room, apartment/house or termination of the rental agreement by the tenant, the following provisions apply:

For a booking up to 6 weeks before the arrival date, you can cancel a reservation within 7 days, calculated from the final booking, without charge. To do this, send an email to info@courcenay.fr stating your booking number and the reason for your cancellation. Courcenay will confirm your cancellation after receipt of this and will refund the deposit.

Cancellations up to 6 weeks before the start of the rental period will be charged 25% of the total travel sum.

In the event of cancellation up to 3 weeks before the start of the rental period, 75% of the total travel sum is due.

In the event of cancellation less than 3 weeks before the arrival date, the entire sum will be due.

If you have not arrived within 24 hours of the agreed arrival date without further notice, this will be considered a cancellation and there is no right to any refund.

In the event of later occupation of, or premature termination of the stay in the apartment, the full rental price remains due.

Cancellations must always be reported in writing (email) to the landlord.

Article 10. Termination or amendment of the rental agreement by the landlord

The landlord can terminate or amend the rental agreement in the following cases:

If the tenant does not pay the rental price (on time).

The tenant brings dog(s) not permitted by the French government and dog(s) not reported in advance, or not approved dog(s). See also our page "Dog rules in and around Courcenay".

Force majeure, war, strike, natural disaster, exceptional weather conditions, fire, death of the landlord or homeowner or their immediate family. All amounts paid by the tenant for nights not yet elapsed will be returned to the tenant within 30 days of termination.

Due to circumstances that are of such a nature that renting out the apartment becomes impossible, such as: theft of inventory, vandalism of the holiday home and unauthorized admission of persons as described in article 7.

If this is attributable to the tenant, paid amounts for nights that have not yet elapsed will not be returned.

The landlord is not liable for any damage suffered by the tenant as a result of the termination of the agreement.

Article 11. Liability and rights

The landlord accepts no liability for:

theft, loss or damage, of whatever nature, suffered by the tenant during or as a result of the rental of and the stay in the rented holiday home.

the breakdown or disabling of technical equipment in the holiday home, temporary failure or malfunctions of water and/or energy management, road and/or construction work in the vicinity of the holiday home.

damage or injury as a result of the use of the holiday home, including inventory, or accidents in and around the holiday home.

The tenant is jointly and severally liable for all loss and/or damage to the rented property and its inventory, regardless of whether this is the result of actions or omissions by the tenant or third parties who are in or around the rented holiday home with the tenant's permission. In the event of incorrect use or incorrect leaving of the rented home, the costs will be charged to the tenant. The landlord will make every effort to provide the tenant with correct information, but is not liable for any unexpected inaccuracies and/or incompleteness in the information provided.

During 2025 and 2026, the landlord reserves the right to carry out any work within and around Courcenay. The landlord will make every effort to limit any form of (noise) nuisance to a minimum. As compensation, a 10% discount will always be applied to every reservation in 2025, when booking directly via our website.

Article 12. Complaints

All complaints relating to the use of the room, holiday home/house must be submitted to the landlord by the tenant immediately. The tenant will give the landlord sufficient opportunity and cooperation to resolve the complaint within a reasonable time.

If the complaint cannot be resolved satisfactorily, the tenant must submit it to the landlord in writing and with reasons. Complaints can be submitted no later than 30 days after the end of the stay in the holiday home.
